Agreement for participation, acknowledgement, release and assumption of risk

Please read this document and do not agree to it unless you are satisfied that you understand it. This document contains your legal rights and obligations. It applies to services provided and activities undertaken both at the premises of Bodytrack Health and Fitness Pty Ltd (‘Bodytrack’) and away from those premises, and other external exercise classes or other consultations.

The “Health Professionals” means any director, authorised representative, servant or agent of Bodytrack.

The “Activity” refers to any personal or group exercise classes including but not limited to strength and/or fitness classes, strength and conditioning classes, personal education or advice.

1. In consideration for, and as a condition to participate in the Activity, I:
   1. acknowledge and agree that while the Activity organised or conducted by Bodytrack is not intended to have inherent dangers and/or risks, there is a risk that I may suffer a physical or mental injury during my participation in the Activity. I confirm that I have disclosed to Bodytrack any medical condition that may affect my ability to safely undertake the Activity and that I have not been advised by any health professional to exclude, restrict or avoid any types of physical activity or exercise due to personal health risks.
   2. agree to release and indemnify Bodytrack and its Health Professionals from any claim, right or cause of action which may be made by me or on my behalf for or in respect of or arising out of any injury, loss, damage or death caused to me or my property by other patrons or third parties;
   3. to the extent permitted by law, I agree to release and indemnify Bodytrack and its Health Professionals from any claim, right or cause of action which may be made by me or on my behalf for or in respect of or arising out of any injury, loss, damage or death caused to me or my property as a consequence of my participation in the Activity.
   4. acknowledge and agree I have undertaken the Activity freely, voluntarily and absolutely at my own risk and with a full appreciation of the nature and extent of all risks involved in the Activity. This waiver shall bind me and my executors.
   5. I have read and understand this waiver of my legal rights.
